These terms apply to all visitors, inquirers, and customers of Ceres Deck and Fence. We may update these terms from time to time. Continued use of our website or services after any change constitutes your acceptance of the revised terms.
Ceres Deck and Fence is a deck building and fence installation contractor based in Ceres, CA. We provide residential outdoor construction services including, but not limited to, custom deck design and construction, composite and wood deck installation, fence installation, pergola installation, covered patio construction, deck repair, and related outdoor building services.
All work is performed by or under the direct supervision of Ceres Deck and Fence staff. We serve homeowners in Ceres and the surrounding communities in the Central Valley. Service availability outside our standard service area is at our discretion.
We provide free, no-obligation written estimates prior to any work beginning. An estimate reflects the scope of work, materials, and pricing discussed at the time of the on-site visit. Estimates are not final contracts.
Estimates are valid for 30 days from the date they are issued, unless otherwise noted in writing. Prices may change after 30 days due to material cost fluctuations or changes in project scope.
If conditions at the job site differ materially from what was visible at the time of the estimate - such as hidden structural damage, permit requirements that were not previously known, or soil conditions that require additional work - we will notify you in writing before proceeding. Additional work beyond the original scope requires a written change order signed by both parties before that work begins.
All prices are in US dollars and do not include applicable sales tax on materials unless stated otherwise in the written estimate.
Project start dates are estimated based on our current workload and permit timelines. We will provide you with a project schedule when you sign a contract. We will notify you promptly of any changes to that schedule.
We require at least 48 hours advance notice to reschedule a site visit or a project start date without penalty. Cancellations made with less than 48 hours notice may result in a scheduling fee.
If you choose to cancel a project after a contract has been signed but before work has begun, any deposit paid may be non-refundable if materials have already been ordered on your behalf. The specific terms of any deposit are stated in your project contract.
We reserve the right to reschedule or suspend work due to weather conditions that would compromise the quality or safety of the work, without penalty to either party.
Payment terms are outlined in your project contract. In general, we require a deposit at the time of contract signing, with the balance due upon project completion. Specific deposit amounts and payment schedules are detailed in each project contract.
Final payment is due upon completion of the work and your walkthrough sign-off. We accept payment by check, bank transfer, or such other methods as stated in your contract.
Invoices not paid within the time frame specified in your contract may be subject to a late payment fee. If a payment is not received within 30 days of the due date, we reserve the right to pursue collection through appropriate legal channels, including small claims court. You may be responsible for our reasonable collection costs and attorney fees in such cases.
Where a building permit is required by the City of Ceres or any other applicable local authority, Ceres Deck and Fence will obtain that permit on your behalf as part of the project. Permit fees are included in the project estimate unless stated otherwise.
You are responsible for providing accurate information about your property, including HOA rules, easements, utility line locations, and any other conditions that may affect the permit or construction process. If inaccurate or incomplete information causes a delay or additional cost, that cost will be passed on to you with advance written notice.
Ceres Deck and Fence stands behind the quality of our workmanship. Workmanship warranty terms are stated in your individual project contract. These warranties cover defects in our installation that arise under normal use and are not caused by misuse, neglect, weather events beyond normal seasonal conditions, or modifications made by others.
Material warranties are provided by the manufacturers of the products we install. We will assist you in submitting a manufacturer warranty claim, but we are not responsible for the manufacturer's response or the terms of their warranty.
The website at ceresdeckandfence.com is provided on an "as is" basis. We make no warranty that the information on the website is complete, accurate, or up to date. Content on the website is for general informational purposes only and should not be relied upon as professional advice for your specific situation.
To the fullest extent permitted by applicable law, Ceres Deck and Fence shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services. If we are unable to resolve a dispute informally, both parties agree to attempt good-faith mediation before pursuing litigation. The costs of mediation shall be shared equally unless otherwise agreed.
If mediation is unsuccessful, disputes shall be resolved through binding arbitration or in a court of competent jurisdiction in Stanislaus County, California, unless otherwise required by law.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to these terms shall be brought exclusively in a court of competent jurisdiction in Stanislaus County, California.
